These General and Specific Terms of Sale (the "Terms") govern sales of products made by Kalysta Paris (the "Seller") to any customer acting as a consumer (the "Customer") on the website kalysta-paris.com (the "Site"). Any order placed on the Site implies prior and unreserved acceptance of these Terms.
These Terms set out the rights and obligations of the parties in connection with the online sale of the products offered by the Seller. They apply to all sales concluded through the Site, to the exclusion of any other document. The Seller reserves the right to amend the Terms at any time; the applicable Terms are those in force on the date of the order.
Before confirming an order, the Customer declares that they have read these Terms and accept them without reservation, by ticking the box provided for that purpose. The Customer acknowledges that they have the legal capacity to enter into a contract.
The products offered are cosmetic products described as accurately as possible (composition, use, characteristics). Photographs and visuals are not contractually binding and may not be relied upon against the Seller. The products comply with applicable cosmetics regulations. Product offers are valid while stocks last.
Prices are shown in euros (€) or Swiss francs (CHF) depending on the market, inclusive of all taxes, excluding delivery charges which are invoiced separately where applicable (see Article 8 and the Specific Terms). The Seller reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force when the order is confirmed. Customs duties or local taxes may apply to deliveries outside the market of origin and remain payable by the Customer.
The Customer selects the products, confirms their cart, enters their delivery and payment details, then confirms the order. The sale is deemed final once the order has been confirmed by email and payment has been collected. The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute over payment for a previous order, or in the event of a manifestly abnormal order.
Payment is made online, at the time of the order, using the methods offered on the Site (in particular payment card, Apple Pay, Google Pay, PayPal, Shop Pay). Transactions are secure. The order is processed only after the payment centre has confirmed authorisation. Payment data is transmitted in encrypted form and is not retained by the Seller.
Products are delivered to the address given by the Customer when ordering. Orders are prepared within 48 business hours. Delivery times are given for guidance only: 5 to 8 business days after dispatch. Delivery charges and conditions are set out in the Specific Terms below. Risk passes when the product is handed over to the Customer. In the event of late delivery, the Customer may contact customer service; in the event of failure to perform after formal notice, the Customer has the remedies provided for by law.
In accordance with the regulations applicable in the European Union, a consumer Customer has 14 days from delivery of their order to exercise their right of withdrawal, without having to give a reason.
Exception (hygiene). In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for cosmetic products that have been unsealed after delivery and cannot be returned for reasons of hygiene or health protection. Unopened, sealed products may be returned under this right.
Independently of this statutory right, the Seller offers a broader commercial guarantee (see Article 10). Detailed terms are set out in the Refund policy.
The Seller offers a commercial guarantee: the Customer may request a refund of their order within 30 days of delivery, with no conditions and at no cost, including where the product has been tried. This commercial guarantee is in addition to the statutory guarantees and does not replace them. The terms are set out in detail in the Refund policy.
Independently of any commercial guarantee, the Customer benefits from the following statutory guarantees:

Cosmetic products are intended for external use, in accordance with the instructions on the packaging. It is for the Customer to check the composition before use and, in case of doubt or sensitive skin, to carry out a patch test first. The Seller may not be held liable for any use that does not comply with the recommendations. The Seller may not be held liable for any damage resulting from the Customer's fault or from an event of force majeure.
The Seller may not be held liable for failure to perform its obligations as a result of an event of force majeure, as defined by law and case law.
The Customer's personal data is processed in accordance with the Privacy policy, which describes the purposes, the recipients and the Customer's rights (access, rectification, erasure, objection, portability).
All items on the Site (trademark, logo, texts, visuals, layout) are protected by intellectual property law and remain the exclusive property of the Seller. Any reproduction or use without authorisation is prohibited.
For any question or complaint, the Customer may contact customer service at info@kalysta-paris.com. The Seller endeavours to reply within 24 to 48 business hours.
In accordance with French regulations, a consumer Customer may, after sending a written complaint to the Seller and failing a satisfactory reply within one month, use a consumer mediator free of charge with a view to the amicable resolution of the dispute.
Note: the European online dispute resolution (ODR) platform was closed on 20 July 2025; no link to that platform is required.
These Terms are governed by the applicable law [TO BE DEFINED with a lawyer, depending on the selling entity]. The mandatory consumer protection provisions of the Customer's country of residence (in particular within the European Union) remain applicable. In the event of a dispute, the Customer may bring proceedings before any of the courts having territorial jurisdiction under the applicable law, at their choice.
Products are offered in euros (€) for the eurozone and in Swiss francs (CHF) for Switzerland. Displayed prices reflect the currency of the delivery market.
"30-day money-back": refund with no conditions and at no cost within 30 days of delivery, with no obligation to return opened products (hygiene reasons). See the Refund policy.
In the event of a conflict between the General Terms and the Specific Terms, the latter prevail as regards the matters they address.
